Terms of Service

1. Acceptance of Terms
By accessing or using the LavingtonPost mobile application (the App), website, or related services (Services), you agree to be bound by these Terms of Service (Terms). If you disagree with any part, discontinue use immediately.
2. Eligibility
- Age Requirement: You must be at least 18 years old, or use the service with the involvement of a parent or legal guardian where permitted by law. - Neighbourhood Focus: Anyone may be able to read public pages, but publishing and restricted community participation are for approved Lavington residents and eligible local businesses. - Verification: We may request contact, residence or business evidence appropriate to the account and explain what is required at the point of collection.
3. User Accounts
Provide accurate account information and protect your sign-in credentials. Email or phone confirmation alone does not grant publishing access. Payment does not buy verification. The Verified checkmark requires a document-review decision. Paid membership benefits, including eligible visibility and support features, are separate from identity verification. We may restrict, suspend or terminate accounts for material violations, fraud, harassment, unlawful activity or repeated commercial spam, subject to applicable law and the available review process.
4. Content Policy
- User-Generated Content: You retain ownership of your content but grant us a license to use, display, and distribute it within the Services. - Prohibited Content: Hate speech, illegal goods/services, counterfeit items, adult content, spam, and misleading information (Consumer Protection Act violations). - Moderation: We reserve the right to remove any content at our sole discretion.
5. Financial Transactions
M-Pesa is supported for app upgrades. Check the current product, amount in KES, duration and benefits in the app before confirming. A pending or uncertain result does not confirm a successful purchase. Purchases are generally non-refundable unless applicable law requires otherwise; disputed transactions are reviewed case by case. No automatic refund or proration is offered. We do not process payments between marketplace buyers and sellers. Payment does not buy verification. The Verified checkmark requires a document-review decision. Paid membership benefits, including eligible visibility and support features, are separate from identity verification.
6. Geofencing and Location
- Location Choice: Device location is used only when you grant permission or choose a location feature. You may withdraw device permission at any time. - Verification Integrity: Deliberately falsifying residence or location evidence may lead to review, restricted access, suspension or termination.
7. Intellectual Property
- Our IP: The LavingtonPost name, logo, and software are protected by copyright and trademark laws. You may not copy or reverse-engineer them.
8. Disclaimers and Limitations
- Service As Is: Services provided without warranties of merchantability or continuous availability. - Limitation of Liability: To the fullest extent permitted by Kenyan law, maximum liability is KES 5,000.
9. Indemnification
You agree to indemnify LavingtonPost against your violation of these Terms and legal costs from your actions.
10. Termination
By you: use Profile → Account Security → Delete Account and follow the available password or Google confirmation. Your account will close immediately. Your profile, posts and Baraza contributions will be removed from view in the app. Private messages, uploaded files and other remaining records will enter a deletion review. Payment and moderation records may be retained after review. This does not cancel an external subscription or issue a refund. Keep the request reference for follow-up. By us: access may be restricted or terminated for breach of these Terms or illegal activity.
11. Dispute Resolution
- Kenyan Law: These Terms are governed by Kenyan laws. Disputes are subject to Nairobi courts. - Mandatory Arbitration: For claims under KES 500,000, binding arbitration in Nairobi under Kenyan Arbitration Act rules.
12. Modifications
We may modify Terms with 30 days' notice via App notification. Continued use constitutes acceptance.
13. Government Requests
We comply with lawful requests from Kenyan courts, Police/DCI, Communications Authority, and Data Commissioner.
