Terms of Service

1. Acceptance of Terms
By accessing or using the LavingtonPost mobile application (the App), website, or related services (Services), you agree to be bound by these Terms of Service (Terms). If you disagree with any part, discontinue use immediately.
2. Eligibility
- Age Requirement: You must be at least 18 years old to use LavingtonPost. Minors (13–17) may use the App only under parental supervision. - Geographic Restriction: Services are exclusively for residents and businesses within Lavington, Nairobi, Kenya. Use outside this geofenced area is prohibited. - Verification Requirements: To post content, you must provide a valid Kenyan phone number, verify residential or business address in Lavington, and submit government-issued ID (for business accounts).
3. User Accounts
- Account Creation: You must create an account with accurate, complete information. You are responsible for all activities under your account. - Account Suspension/Termination: We may suspend or terminate accounts for violation of these Terms, providing false information, illegal activities, harassment, or commercial spam. - Kenyan ID Verification: Business accounts require a valid Kenyan National ID or Passport, business registration certificate, and KRA PIN certificate.
4. Content Policy
- User-Generated Content: You retain ownership of your content but grant us a license to use, display, and distribute it within the Services. - Prohibited Content: Hate speech, illegal goods/services, counterfeit items, adult content, spam, and misleading information (Consumer Protection Act violations). - Moderation: We reserve the right to remove any content at our sole discretion.
5. Financial Transactions
- In-App Purchases: Payments for 'Boosts' or premium features are processed via M-Pesa. All fees are in KES and inclusive of VAT. - Refund Policy: Generally, all purchases are non-refundable unless required by Kenyan law. Disputed transactions are handled case-by-case. - Third-Party Transactions: We do not process payments between buyers and sellers on the marketplace. We are not liable for transaction disputes.
6. Geofencing and Location
- Location Tracking: You consent to location verification to ensure compliance with our Lavington-only restriction. - Falsification: Spoofing or faking location data results in immediate permanent account termination.
7. Intellectual Property
- Our IP: The LavingtonPost name, logo, and software are protected by copyright and trademark laws. You may not copy or reverse-engineer them.
8. Disclaimers and Limitations
- Service As Is: Services provided without warranties of merchantability or continuous availability. - Limitation of Liability: To the fullest extent permitted by Kenyan law, maximum liability is KES 5,000.
9. Indemnification
You agree to indemnify LavingtonPost against your violation of these Terms and legal costs from your actions.
10. Termination
- By You: Delete account via App settings. - By Us: We may terminate for breach of Terms or illegal activities.
11. Dispute Resolution
- Kenyan Law: These Terms are governed by Kenyan laws. Disputes are subject to Nairobi courts. - Mandatory Arbitration: For claims under KES 500,000, binding arbitration in Nairobi under Kenyan Arbitration Act rules.
12. Modifications
We may modify Terms with 30 days' notice via App notification. Continued use constitutes acceptance.
13. Government Requests
We comply with lawful requests from Kenyan courts, Police/DCI, Communications Authority, and Data Commissioner.
